At Earthworks, we pay employees who perform the work that the H2B employees perform on a daily rate, as permitted by 29 CFR 778.112. In such a week where overtime is worked, the employees would then be paid the additional half-time overtime premium for overtime hours. The additional half-time premium for overtime hours is permissible because the daily rate itself constitutes the straight time pay for all hours worked. For overtime hours, all that remains to be paid is the additional half-time.
